Housing Disrepair

Does your property suffer from disrepair?

The Housing Disrepair sector in the UK focuses on issues concerning the condition and maintenance of rental properties. It involves tenants seeking legal recourse against landlords who fail to maintain their properties in a habitable and safe state.

What disrepair can I claim for?

Persistent dampness and mould resulting from poor ventilation or structural defects.

Issues with the property’s structure, including subsidence, cracked walls, or faulty roofing.

Leaks, broken pipes, and inadequate drainage.

Faulty heating systems or unsafe electrical installations.

Presence of pests such as mice and rats.

Maintenance of shared areas in multi-occupancy buildings.

Housing disrepair claims typically address the following issues:

Turn to Christopher Law! Our team of skilled solicitors, consultants, and experts brings extensive experience and in-depth knowledge to the housing disrepair sector, ensuring we provide a top-tier legal service.

Our goals are straightforward:

We achieve this by offering expert guidance and support to tenants. Our team typically works on a no-win, no-fee basis and is responsible for liaising with the landlord to ensure justice by managing and advancing the claim through to its conclusion.

Our success rate speaks for itself

As long as you have notified the landlord about the disrepair, your claim is likely to succeed providing that the repairs have not been completed within an acceptable time frame.

How does the process work?

1.

A member of our team will contact you to obtain your details and discuss the disrepair in your property.

2.

A dedicated file handler will be appointed to deal with your claim and notify the Landlord of the claim.

3.

We will continue to liaise directly with the Landlord and make use expert opinions and evidence until a settlement is reached.

4.

We will maintain contact with you throughout the process and provide you with tailored advice up until the repairs have been completed.

What requirements are there in order to make a claim against my Landlord?

To pursue a housing disrepair claim successfully:

  1. You must have reported the disrepair issues to the landlord.
  2. The landlord must have been given adequate time to address the issues.

If the landlord fails to remedy the situation within a reasonable period, a claim can be pursued.

The typical process for a housing disrepair claim is as follows:

  • Initial assessment: The tenant identifies and reports disrepair issues to the landlord in writing.
  • Landlord’s response: The landlord is given a reasonable period to inspect the property and respond.
  • Legal action: If the landlord fails to act, the tenant may pursue legal action against them.
  • Medical and expert reports: Assessments may be needed to determine the extent of disrepair and health impacts.
  • Court proceedings: If unresolved, the case proceeds to court for a judicial decision.
